As of 1 August 2018, all modern awards have been varied to allow employees access to 5 days of unpaid leave each year to deal with family and domestic violence. The leave does not accumulate from year to year.
This applies to all employees covered by an industry or occupation award, including casual employees.
Employers can request evidence from an employee to prove that the employee took the leave to deal with family and domestic violence. This evidence could be;
- Documents issued by the police
- Court documents
- Support group documents
- A statutory declaration
All evidence provided to the employer must be treated confidentially.
